Terms of Use
These Terms of Use, together with all policies, rules, notices, and supplemental terms incorporated by reference, including the Community Guidelines, Privacy Policy, and any product-specific or payment-specific terms that we may publish from time to time, constitute a legally binding agreement between you and RC TECH AMERICA INC, its affiliates, successors, and assigns, as applicable, concerning your access to and use of Omegle, omegle.com, and any related websites, livestreaming services, interactive features, communications tools, creator monetization tools, paid features, virtual items, software, APIs, and other services that link to these Terms.

Please read these Terms carefully. By creating an account, accessing the Service, broadcasting, viewing content, purchasing Tokens or other digital items, subscribing to a Creator, receiving payouts, clicking “I agree,” or otherwise using the Service, you confirm that you have read, understood, and agreed to these Terms. If you do not agree, you must not access or use the Service.

Adults only (18+). The Service is intended only for adults who are at least eighteen years old, or the age of majority in their jurisdiction, whichever is higher. You may not access or use the Service if you are under eighteen years old or otherwise lack legal capacity to enter these Terms.

1. Definitions
“Service” means the website, platform, live streaming service, user-generated content service, chat features, creator tools, payment features, virtual item systems, moderation tools, and related services operated or made available through Omegle.

“User” means any person who accesses or uses the Service, including viewers, registered account holders, broadcasters, Creators, moderators, subscribers, purchasers, and visitors.

“Creator” means a User who broadcasts, uploads, streams, posts, hosts, sells access to, receives virtual gifts for, receives subscriptions for, or otherwise monetizes User Content through the Service.

“User Content” means any content, material, information, data, livestream, video, audio, image, text, chat message, profile information, display name, avatar, comment, reaction, virtual room, channel title, description, tag, link, metadata, or other material that a User submits, posts, transmits, streams, displays, uploads, or otherwise makes available through the Service.

“Platform Content” means all content, software, interfaces, designs, trademarks, logos, technology, documentation, moderation systems, data structures, and other materials made available by us, excluding User Content.

“Tokens” means virtual coins, points, credits, balances, or similar digital units made available through the Service for use solely within the Service.

“Virtual Items” means virtual gifts, badges, effects, access features, subscription benefits, digital expressions, or other digital items or benefits made available through the Service.

“Adult-Oriented Content” means non-explicit, lawful, consensual, non-exploitative content created and accessed only by verified adults that may include suggestive performance, adult conversation, adult humor, sensual presentation, revealing attire, or other mature themes, subject to these Terms and the Community Guidelines.

2. Service Eligibility and Age Verification
Account registration is required to use the Service. We may apply basic age-gating and risk checks before access. We will require successful third-party age assurance, including k-ID or another approved provider, before allowing a User to broadcast, appear on camera or microphone, enter live video interaction, monetize, receive payouts, or use other high-risk or adult-restricted features, and we may require identity verification, payment verification, liveness checks, device checks, location checks, risk scoring, documentary checks, or other reasonable verification measures. We will deny access to any User who fails, refuses, or cannot complete required age verification, and may restrict, suspend, or terminate access to any User whom we identify or reasonably suspect to be under eighteen, using false information, evading verification, or facilitating access by minors. We will deny or restrict access to restricted features for any User who fails, refuses, or cannot complete required age assurance, and will deny access to any User whom we identify or reasonably suspect to be under eighteen, to be using false information, to be evading verification, or to be facilitating access by minors.

You must not permit any minor to access your account, appear in your livestream, participate in your content, communicate through your account, use your payment method, or otherwise access the Service. You must not create an account for a minor or encourage, assist, solicit, or enable any minor to access the Service.

You represent and warrant that all information you provide to us, including age, identity, location, payment, tax, and payout information, is accurate, current, complete, and not misleading. You must promptly update such information if it changes.

3. Account Registration and Security
You must create and maintain an account to use the Service. You are responsible for maintaining the confidentiality and security of your login credentials and for all activity that occurs under your account, whether authorized by you or not. You must promptly notify us at legal@omegle.com if you suspect unauthorized access, account compromise, fraud, impersonation, misuse, or any safety risk.

We may require additional verification for accounts that broadcast, monetize, receive payouts, make high-value purchases, trigger safety signals, receive repeated reports, engage in high-risk conduct, or otherwise present legal, safety, fraud, chargeback, sanctions, tax, age-assurance, or platform integrity concerns.

You must not sell, rent, transfer, share, sublicense, or assign your account or account credentials, except with our prior written permission. We may reclaim usernames, handles, channel names, room names, display names, or other identifiers where necessary to protect rights, prevent impersonation, comply with law, avoid user confusion, or maintain platform integrity.

4. Nature of the Service
The Service is a user-generated live streaming and interactive community platform. We provide hosting, communication, monetization, moderation, reporting, and related technical tools. Except where expressly stated otherwise, User Content is created, selected, transmitted, and controlled by Users, not by us.

We are not responsible for pre-approving all User Content. However, we may use automated systems, artificial intelligence, human review, user reports, trusted flagger reports, risk signals, complaint channels, and other measures to detect, restrict, remove, block, classify, demonetize, age-gate, or otherwise act on User Content or accounts. We may take enforcement action at our discretion where we believe content or conduct violates these Terms, the Community Guidelines, law, third-party rights, payment rules, safety standards, or platform integrity requirements.

5. Incorporation of Community Guidelines and Other Policies
Your use of the Service is subject to the Community Guidelines and all other policies we publish or make available in connection with the Service. The Community Guidelines explain what content and conduct are allowed, restricted, age-gated, demonetized, or prohibited. They apply to all Users, all User Content, all livestreams, all chats, all profiles, all monetization activity, all interactions, and all attempts to use the Service.

If there is a conflict between these Terms and a supplemental policy, the more specific policy governs the relevant subject matter, unless these Terms expressly state otherwise. We may update our policies from time to time, and continued use of the Service after an update constitutes acceptance of the updated policies to the extent permitted by applicable law.

6. Adult-Oriented Content
The Service may permit limited Adult-Oriented Content only if it is lawful, consensual, non-explicit, non-exploitative, properly categorized, visible only to verified adult Users where required, and fully compliant with the Community Guidelines.

Adult-Oriented Content is not a permission to post or stream pornography, nudity, sexual acts, explicit genital display, explicit sexual content, sexual exploitation, prostitution, escorting, trafficking, coercion, non-consensual intimate content, voyeuristic content, revenge pornography, sexual blackmail, sexual extortion, content involving or appearing to involve minors, child sexual abuse material, grooming, age-play involving minors, incest involving minors, or any content that violates law or platform policy.

We may require mature-content labels, audience restrictions, content classification, reduced discoverability, limited monetization, additional verification, additional moderation, or other controls for Adult-Oriented Content. We may remove, restrict, demonetize, suspend, terminate, or report content or accounts where we believe the content crosses legal, safety, consent, exploitation, platform integrity, or payment-network boundaries.

7. Safety, Moderation, and Enforcement
We may deploy automated and human safety systems to protect Users, prevent illegal content, reduce platform abuse, and enforce these Terms. These systems may include artificial intelligence content moderation, automated detection of nudity, violence, suspected CSAM, exploitation indicators, grooming signals, fraud indicators, spam indicators, and other high-risk content or behavior.

For livestreams, we will use standard stream latency, buffering, automated pre-transmission interception, real-time risk scoring, content blocking, stream interruption, post-event review, and human safety adjudication. High-risk content may be automatically flagged, blocked, removed, retained for review, escalated to a high-priority queue, referred to specialized reviewers, or reported to law enforcement or child-safety organizations where appropriate.

We will provide “one-click report” or similar reporting tools on livestream, video interaction, chat, profile, and other core product interfaces so that Users can report unsafe, illegal, infringing, abusive, or policy-violating content. We will establish a High Priority review queue for urgent safety reports, with human review and disposition targeted within a defined short timeframe and may conduct high-frequency monitoring of accounts, streams, rooms, devices, payment instruments, or Users associated with repeated reports, severe violations, suspicious activity, or other risk signals.

We may take any enforcement action we consider appropriate, including warning, labeling, age-gating, reducing discoverability, removing content, disabling chat, interrupting a stream, limiting monetization, withholding payouts, suspending purchases, freezing Tokens, disabling account features, requiring reverification, terminating accounts, banning devices, blocking access, preserving evidence, reporting to law enforcement, or cooperating with regulators, NGOs, safety organizations, payment partners, or rights holders.

8. Reporting Illegal Content, Safety Issues, and Policy Violations
You may report suspected violations using in-product reporting tools or by contacting legal@omegle.com. Reports should include sufficient information to allow us to locate the content or conduct, such as username, channel name, URL, date, time, description, screenshots, transaction information, and any safety urgency.

If you believe content involves a minor, CSAM, grooming, sexual exploitation, trafficking, imminent physical harm, credible threats, non-consensual intimate imagery, or other emergency safety concerns, you should report it through the Service and contact local law enforcement or emergency services where appropriate.

We may not respond individually to every report. We may use reports to improve safety systems, enforce policies, communicate with Users, provide statements of reasons where legally required, and satisfy regulatory or legal obligations.

9. Law Enforcement, NCMEC, and Safety Cooperation
We may establish and maintain legal liaison functions to cooperate with law enforcement agencies, regulators, child-safety organizations, and non-governmental organizations, including the National Center for Missing and Exploited Children where applicable.

We may preserve, use, or disclose information, and where legally required will report information, including User Content, account data, IP addresses, device data, payment information, communications, and moderation records, where we believe in good faith that doing so is necessary or appropriate to comply with law, respond to legal process, report suspected CSAM or child exploitation, protect Users, prevent harm, investigate fraud, enforce these Terms, defend legal claims, protect our rights, or cooperate with safety organizations or authorities.

10. User Content Ownership and License
You retain ownership of rights you have in your User Content, subject to the license granted below and any rights held by third parties.

By submitting, posting, streaming, transmitting, or otherwise making User Content available through the Service, you grant us a worldwide, non-exclusive, transferable, sublicensable, royalty-free, fully paid, perpetual to the extent permitted by law, and irrevocable license to host, store, reproduce, copy, process, adapt, modify, transcode, format, translate, create derivative works from, publish, publicly perform, publicly display, distribute, transmit, broadcast, stream, make available, promote, monetize, analyze, moderate, remove, and otherwise use your User Content in connection with operating, providing, improving, promoting, protecting, and enforcing the Service and our business.

This license includes the right to use your User Content for content moderation, trust and safety, legal compliance, advertising of the Service, platform recommendations, search, discovery, analytics, product development, technical optimization, and dispute resolution. The license also includes the right to make User Content available to other Users according to your settings and the functionality of the Service.

You represent and warrant that you own or have all necessary rights, licenses, permissions, consents, and clearances to submit and license your User Content and that your User Content does not violate law, these Terms, the Community Guidelines, privacy rights, publicity rights, intellectual property rights, contractual rights, or other third-party rights.

11. Music, Third-Party Rights, and Copyright
You are responsible for ensuring that your User Content does not infringe copyright, trademark, publicity, privacy, or other rights. This includes music, sound recordings, lyrics, video clips, images, broadcasts, sports content, television content, film content, software, game footage, brand assets, third-party performances, and other protected materials.

You must not stream, upload, or use copyrighted music or other protected works unless you have all necessary rights or your use is legally permitted. We may remove, mute, disable, block, restrict, demonetize, or terminate content or accounts in response to rights-holder claims, automated rights-management signals, repeat infringement, or legal requirements.

We may adopt and enforce a repeat infringer policy. We may terminate accounts of Users who repeatedly infringe or are repeatedly alleged to infringe third-party rights, subject to applicable law.

12. DMCA and Copyright Complaints
If you believe that material on the Service infringes your copyright, you may submit a copyright notice to legal@omegle.com. A valid notice should include the information required by the Digital Millennium Copyright Act or other applicable copyright law, including identification of the copyrighted work, identification of the allegedly infringing material, your contact information, a statement of good-faith belief, a statement under penalty of perjury, and your physical or electronic signature.

If your content was removed due to a copyright notice and you believe the removal was mistaken or misidentified, you may submit a counter-notice that satisfies applicable legal requirements. We may forward notices and counter-notices to the relevant parties and may restore material where legally appropriate.

We may remove content, disable access, terminate accounts, or take other action for suspected infringement, repeat infringement, abusive notices, fraudulent claims, or misuse of the copyright process.

13. Platform Content and Limited License
Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for personal, lawful, non-commercial use, except where we expressly authorize Creator monetization or other business use through approved platform features.

You may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, scrape, crawl, index, train models on, exploit, or create derivative works from the Service or Platform Content except as expressly permitted by us or applicable law.

All rights not expressly granted are reserved by us and our licensors.

14. Prohibited Uses
You must not use the Service to violate law, infringe rights, harm others, evade safety systems, manipulate platform systems, commit fraud, distribute malware, scrape data, impersonate others, exploit minors, engage in harassment, facilitate illegal services, conduct gambling, launder money, sell accounts, trade Tokens outside the Service, manipulate Creator payouts, engage in chargeback fraud, artificially inflate engagement, or interfere with the Service.

You must not attempt to bypass age verification, content moderation, geographic restrictions, payment rules, sanctions controls, account suspensions, device bans, or other security measures.

You must not register, use, sell, route traffic through, promote, or facilitate any domain name, app, account, room, advertisement, or social-media presence that uses or is confusingly similar to Omegle, or our other trademarks without our prior written permission; we may investigate, preserve evidence, suspend accounts, block links, and pursue UDRP, trademark, infringement, or other legal remedies.

You must not use the Service to develop, train, or improve competing products, automated systems, artificial intelligence models, biometric systems, recognition systems, or safety-evasion tools without our prior written permission.

15. Virtual Items and Digital Content
Virtual Items are limited, revocable digital licenses for entertainment and interaction within the Service. They are not money, currency, stored value, e-money, securities, commodities, financial instruments, property, or deposits. They have no cash value outside the Service and may not be redeemed for money by viewers or purchasers, except where we separately authorize Creator payouts under applicable Creator Monetization Terms.

You do not own Virtual Items or Digital Content. You receive only a limited right to use them within the Service, subject to these Terms. We may modify, suspend, revoke, expire, reprice, limit, or discontinue Tokens, Virtual Items, features, benefits, or balances at any time, subject to applicable law.

You must not sell, buy, barter, trade, transfer, assign, pledge, encumber, exchange, broker, or attempt to monetize Tokens, Virtual Items, accounts, subscriptions, or digital benefits outside the Service. Any attempted transfer is void and may result in account suspension, forfeiture, payout withholding, or other enforcement action.

16. Purchases, Subscriptions, and Payments
The Service may allow Users to purchase Virtual Items, subscriptions, premium features, paid access, or other digital content. Prices, taxes, payment methods, renewal terms, refund rules, and feature availability may vary by jurisdiction, product, currency, device, payment provider, promotional offer, and time.

You authorize us and our payment processors to charge your selected payment method for purchases, subscriptions, renewals, taxes, fees, and other amounts you incur. You are responsible for all charges made under your account.

Subscription services may renew automatically unless canceled before the renewal date, where permitted by law and disclosed at purchase. You may cancel subscriptions through the applicable account settings or payment provider interface. Cancellation generally stops future renewals but does not automatically entitle you to a refund for prior charges, except where required by law or expressly stated by us.

All purchases of Virtual Items and digital content are final and non-refundable except where required by applicable law, expressly stated in the applicable purchase flow, or determined by us in our discretion. We may refuse refunds where we detect fraud, abuse, chargeback misuse, policy violations, or use of the purchased digital content.

17. Privacy and Data Protection
Our collection, use, disclosure, and protection of personal information are described in our Privacy Policy. By using the Service, you acknowledge that we may process information necessary to provide, secure, moderate, personalize, analyze, and improve the Service; verify age and identity; process payments and payouts; comply with legal obligations; respond to reports; enforce policies; and protect Users.

We may process biometric, identity, payment, or verification-related data where necessary for age assurance, identity verification, fraud prevention, safety, or legal compliance, subject to applicable law and our Privacy Policy. Where we use third-party verification providers, their processing may also be subject to their own terms and privacy notices.

18. Content Moderation Transparency, Appeals, and Notices
We may provide notices, statements of reasons, complaint-handling options, or appeal mechanisms where required by applicable law or where we choose to do so. If your content or account is restricted, removed, suspended, demonetized, or otherwise affected, you may have the ability to appeal through the tools or contact channels we provide.

Appeals must be submitted in good faith and should include relevant facts and supporting materials. We may reject abusive, repetitive, fraudulent, bad-faith, or irrelevant appeals. We may uphold, modify, or reverse enforcement decisions.

For Users in jurisdictions with mandatory content-moderation appeal rights, consumer rights, or platform transparency rights, nothing in these Terms limits rights that cannot be waived under applicable law.

19. EU, EEA, UK, Australian, Canadian, and Other Non-U.S. Users
The Service is offered globally, but laws vary by jurisdiction. If you access the Service from outside the United States, you are responsible for complying with local laws. We may restrict features, content, purchases, monetization, payouts, or access by country or region.

For Users in the European Union or European Economic Area, we may provide illegal content notice-and-action mechanisms, statements of reasons, internal complaint-handling, trader disclosures, transparency information, and other rights where required by the Digital Services Act or other applicable law.

For Users in the United Kingdom, Australia, Canada, or other jurisdictions with online safety, consumer protection, age assurance, or content regulation frameworks, we may implement localized safety measures, reporting channels, age checks, content restrictions, complaint processes, or other compliance controls.

Nothing in these Terms excludes, limits, or modifies any consumer guarantee, statutory right, mandatory withdrawal right, refund right, unfair contract protection, or other right that cannot be excluded under applicable law. If any provision of these Terms is unenforceable against a consumer in a particular jurisdiction, that provision applies only to the maximum extent permitted by law.

20. Termination
You may stop using the Service at any time. You may request account deletion through available account tools or by contacting us, subject to identity verification, legal retention, safety retention, fraud prevention, tax, payment, dispute, and compliance obligations.

We may suspend or terminate your account or access to the Service at any time where we believe you have violated these Terms, violated law, created safety risk, created payment risk, misused the Service, infringed rights, failed verification, or otherwise harmed the Service or other Users. We may also discontinue the Service, features, monetization programs, or geographic availability at any time.

Upon termination, your right to use the Service ceases immediately. We may retain or delete User Content and account data according to our Privacy Policy, legal obligations, safety needs, and legitimate business purposes. Sections that by their nature should survive termination survive, including ownership, licenses, payments, payouts, disclaimers, limitations of liability, indemnity, dispute resolution, and enforcement provisions.

21. Disclaimers
The Service is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, security, accuracy, uninterrupted operation, error-free operation, and absence of harmful components.

We do not guarantee that the Service will be available in any location, uninterrupted, secure, error-free, profitable, suitable for any Creator, or free from offensive, harmful, inaccurate, illegal, or objectionable User Content. You use the Service at your own risk.

We are not responsible for User Content, User conduct, third-party services, payment provider failures, unauthorized access, loss of data, Creator earnings, audience size, discoverability, moderation outcomes, or disputes between Users, except to the extent required by applicable law.

22. Limitation of Liability
To the maximum extent permitted by law, RC TECH AMERICA INC, its affiliates, officers, directors, employees, contractors, agents, licensors, and service providers will not be liable for indirect, incidental, consequential, special, exemplary, punitive, or enhanced damages, loss of profits, loss of revenue, loss of goodwill, loss of data, business interruption, reputational harm, or other intangible losses arising out of or relating to the Service or these Terms, even if advised of the possibility of such damages.

To the maximum extent permitted by law, our total liability for all claims arising out of or relating to the Service or these Terms will not exceed the greater of: (a) the amount you paid to us for the Service in the twelve months before the event giving rise to liability; or (b) USD 100.

Some jurisdictions do not allow certain limitations of liability. In such jurisdictions, the limitations apply only to the maximum extent permitted by law.

23. Indemnity
You agree to defend, indemnify, and hold harmless RC TECH AMERICA INC, its affiliates, officers, directors, employees, contractors, agents, licensors, and service providers from and against any claims, demands, actions, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to: your use of the Service; your User Content; your violation of these Terms; your violation of law; your violation of third-party rights; your purchases, subscriptions, monetization, payouts, taxes, advertising, or Creator activity; your fraud, misconduct, negligence, or willful misconduct; or any dispute between you and another User.

We may assume exclusive control of any matter subject to indemnification, and you agree to cooperate with our defense. You may not settle any claim without our prior written consent if the settlement imposes obligations on us, admits liability by us, or affects our rights.

24. Governing Law
These Terms and any dispute, claim, or controversy arising out of or relating to these Terms or the Service are governed by the laws of the State of California, United States, without regard to conflict-of-law principles, except to the extent that applicable consumer protection laws require otherwise.

25. Arbitration Agreement; Class Action Waiver
Except for disputes that qualify for small claims court, individual claims of sexual assault or sexual harassment arising from use of the Service where arbitration cannot lawfully be required, disputes involving intellectual property infringement or misuse, disputes seeking emergency injunctive relief, or disputes that cannot be arbitrated under applicable law, you agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Service, User Content, purchases, subscriptions, Tokens, Virtual Items, monetization, payouts, privacy, safety, enforcement, or any relationship between you and us will be resolved by binding individual arbitration administered by AAA under its applicable consumer or commercial arbitration rules.

You agree that arbitration will be conducted only on an individual basis and not as a class, collective, consolidated, representative, private attorney general, or mass action, except to the extent this waiver is unenforceable under applicable law. The arbitrator may award relief only in favor of the individual party seeking relief and only to the extent necessary to resolve that party’s individual claim.

Before initiating arbitration, the party seeking arbitration must send a written notice of dispute to the other party describing the claim and requested relief. The parties will attempt in good faith to resolve the dispute informally for at least thirty days after receipt of the notice.

Unless otherwise required by law or agreed by the parties, arbitration will be conducted in California, in English, by a single arbitrator. The arbitrator will have authority to award any individual relief available in court, subject to these Terms. Judgment on the award may be entered in any court of competent jurisdiction.

Either party may bring an individual claim in small claims court if the claim qualifies. Either party may seek injunctive or equitable relief in court to protect intellectual property, confidential information, account security, platform integrity, safety, or to prevent unauthorized access, scraping, infringement, exploitation, or misuse of the Service.

If the class action waiver is found unenforceable as to a particular claim, that claim must proceed in court and not arbitration, unless the parties agree otherwise.

26. Changes to the Service and Terms
We may modify, suspend, or discontinue the Service, features, pricing, monetization programs, virtual items, subscription benefits, content rules, verification requirements, or these Terms at any time. We may provide notice of material changes where required by law or where we determine notice is appropriate.

Your continued use of the Service after the effective date of updated Terms constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.

27. Miscellaneous
These Terms constitute the entire agreement between you and us regarding the Service, except for supplemental terms incorporated by reference. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, sale of assets, change of control, or by operation of law.

No agency, partnership, joint venture, employment, fiduciary, or franchise relationship is created by these Terms.
